1 Collaborative Law

ABA Lawyer as Problem Solver Award Honors Stuart Webb and Pauline Tesler

Stuart Webb and Pauline Tesler, creators and promoters of Collaborative Law, will be recognized by the American Bar Association on August 11th with the Lawyer as Problem Solver Award. The ABA Section of Dispute Resolution created the Lawyer as Problem Solver award to recognize lawyers who in their professional capacities use their lawyering and problem-solving skills to help clients forge creative solutions. The award is given to a member of the legal profession who has exhibited extraordinary skill in either promoting the concept of the lawyer as problem-solver or resolving individual, institutional, community, state, national, or international problems. Recipients will be acknowledged for their use or promotion of collaboration, negotiation, mediation, counseling, decision-making, and problem-solving skills to help clients resolve a problem in a creative and novel way. The Lawyer as Problem Solver Awards  Luncheon will take place on August 11th, during the ABA Annual Meeting in
Washington , D.C.

     I am representing 43 wonderful people who are federal criminal defendants in USDC in
Columbus Georgia .  They stand charged with federal trespass onto Fort Benning Georgia to protest the School of the Americas/WHISC last November.  The School of Americas has a long and terrible history training and graduating leaders from the militaries of Central and South America who have gone on to commit horrendous human rights violations.  Find out more at  www.soaw.org

     If anyone has federal criminal defense experience we would love to have you join us for trial on
July 8, 2002 .  I have put in considerable time with these folks over the past few months.  They are a very committed and self-educated bunch.  We have some pleading guilty, some stipulating to the facts and giving statements of conscience, some going pro se, and some who will oblige the government to prove the crime.  We have filed motions for international law experts and evidence of necessity, etc.

    Last year the same judge gave most of the 26 people charged the maximum of 6 months in prison, including one 82 year old nun. This year the government has chosen 43 people who range in age from 18 to grandparents, and in occupation from Presybyterian ministers (2), students, teachers, social workers, artists, priests, nuns, and a lot of other wonderful folks.   Contact: Bill Quigley  504-861-5591

9 Therapeutic Jurisprudence


The Western Criminology Review is the official journal of the Western Society of Criminology.  Published twice a year, the WCR is one of the only on-line, peer-reviewed outlets for scholarly research in all matters important to criminology and criminal justice.  http://wcr.sonoma.edu. This year a special volume building on public discussion of current issues in Therapeutic Jurisprudence is scheduled for publication this fall. Next year’s special volume will be dedicated to issues of Environmental Criminology and Crime Analysis. Manuscripts for consideration should be sent to David Wexler at davidbwexler@yahoo.com. The City University of New York Dispute Resolution Consortium at John Jay College of Criminal Justice has received a grant to conduct research on the ADR responses to the September 11th attacks.  The acts of terrorism have spun off a wide range of conflicts and disputes which have been handled by mediators, facilitators, conciliators and other conflict resolvers. 13 RL Leadership


Highlighted member of leadership:  Each month, we highlight a member of our board.  This month, our focus is on Kevin Ginsberg.

Kevin Ginsberg, J.D., LMT is a founding board member of Renaissance Lawyer Society. Kevin is both a licensed attorney and massage therapist in North Carolina .

After graduating from the
University of North Carolina at Chapel Hill with a Bachelors of Science in Business Administration in 1994, Kevin deferred his acceptance into law school for a year in order to travel throughout Europe and spend all of the Bar Mitzvah money he had been saving since he was thirteen years old.  During this time he began to study several disciplines of yoga and meditation, including the use of juggling as a mindfulness practice.

While running away from some children in
Dublin , Ireland who were trying to mug him, he had an epiphany - that he would teach grade school to underprivileged children for the Teach For America program instead of going to law school. Despite his mom's shpilkes, he wrote a letter, in pencil, with mistakes scratched out, not even properly erased, to the Dean of UNC's School of Law saying "Thanks, but no thanks, I am going to Teach For America!" When he failed to qualify for the program, however, he crawled back to the law school and asked for his space back. His admission was granted, and he then went on to attend his first year of law school. During this first year of law school, Kevin had another epiphany - again that he would teach grade school to underprivileged children for the Teach For America program instead of continuing law school. So he applied again, was accepted and left for Baltimore where he spent two years teaching beautiful fourth and sixth grade children.

Upon returning to law school, which he found considerably easier and less stressful than teaching fourth and sixth graders, Kevin concurrently enrolled in one of the nation's premier massage therapy programs, the Body Therapy Institute in
Siler City , North Carolina . It was during this time of right brain/left brain immersion that he began to explore the possibilities of integrating holism and spirituality with the law and met J. Kim Wright in her Graham, North Carolina law practice.  This liaison eventually helped to
create Renaissance Lawyer Society.

Now a master juggler, Kevin presents at schools and workshops, coaches private lessons and facilitates "Mindfulness Juggling" workshops.

Formerly a clerk for the North Carolina Court of Appeals, Kevin currently is developing a private practice that integrates the use of therapeutic massage and bodywork, breathing, stretching and meditation practices, legal counseling, juggling, coaching and haiku writing. He was married in March, 2002 and lives with his wife and 120 pound shepherd/ retriever, Stogie Kyleberg.
